I am using DOS visa statistics and I arrived at EB quota numbers for 2008 as 162,707. There were 22,707 unused FB visa's in 2007 based on the DOS visa statistics @ http://travel.state.gov/visa/frvi/statistics/statistics_1476.html

Nixtor, this idea is worth trying. If people who are buyinh house can be exempted from the VB quota, this will free up extra visas and will help those people who will not buy a house.

I did read that part and hence my question was if I am in the fourth/fifth year of my CA PR when I decide to go to CA, will I be allowed at least in the country.
Another question was if I am in my 4th/5th year and know that it might take me another year before I go to CA, can I apply for CA PR again, even when I already have my CA PR OR if I apply for my CA PR immediately after my current CA PR expires, would I get it again (assuming I have the necessary points)

If Dept of State finds by mid of the month all(not by country) EB3 or EB2 numbers consumed, then they may come back and say no more acceptance of particular category. But generally they don't want to do that for EB category applications, because it is difficult for them to evaluate, reason is some numbers from Family category will be transfered to EB categories.
It happened for EB2 India, in the month of July 2006 mid. All numbers for EB2 India were utilized before mid of July, but even then they didn't come back in the mid of the month. So they made it "U" in next bulletin.

Guys we often discussed about facing problems at Port of entry. People being questioned for hours or rumors about people being sent back. I was surprised by reading this news today. This country is going crazy about stopping people just because their surname is "Khan" even if the person has travelled to US earlier. With experience i expect people to get smarter but these people are getting dummer.
I dont understand whats so special about SRK...is he god or what. TSA/IO has every right to question any one entering the country. Its their job. Indian Media is making it big issue about this just to get more attention from public. This is cheap advertisement for them. Our country is so corrupt...if you are celebrity and Politician you can get away with any system.

I couldn't agree more with you. The limited number of GC is definitely a critical factor. But we have contributed to this mess ourselves. Look what happened with EB2 India. Did India started producing EB2 talents overnight? No; rather we started polishing our resumes with inflated years of experience and job description so that we can apply to EB2. The system is too liberal and based on trust. If employers start scrutinizing resumes and certificates a lot of applicants will simply drop off from the GC queue.
I do not fully agree with you. There could be inflated years on a resume but for EB2 one needs to provide experience letters showing five plus years experience. Not many companies give out false information in the experience letters.

Grassley bill will not close the door for immigrants but will decrease substanially from 200k(H1+L1) to 80k. But retrogession will go down and those 80k will have less problem in getting green card. You can chose whether to allow unlimited L1 and 125K h1b and 10 to 15 years waiting time or allow 30K L1 + 50K H1b and 3 to 5 years waiting time in green card. Which option will be better for you? If your skills are not good certainly you will not want any restrictions. If your skills are excellent you will survive whatever restrictions they put. They cannot reduce H1b below 65k as that is a part of WTO. So there is no one can block H1b program.

If a company hired you for 2 days just to allow you to file 485 with no intent to have a job ready for you in future, the company and you commited immigration fraud --- a bigger problem. Also, you cannot invoke AC21 to switch employer before 180 days after you file 485. So, it still remains a mystery how you moved out just after filing 485.
Your favor towards Grassleys bill shows you just want to close the door. Grassleys bill, if implemented will make it very difficult for even legit employers to get H1 employee. It is a kin to almost closing H1 program out of which you benefitted.

I thought the same way as you did too. I am no fan of these job shop companies but remember some one will pay the price and face hardships I hope its just those companies not the employees. But the way things are if this gets effective employees can also get into a limbo - which I dont like - like say someone has gone for visa stamping and that gets denied or worst his/her family is still in the US - or something like that. Its true that the employee should try and look for a new job opportunity meeting new regulations but its not easy as it sounds.
More important point to consider is that new rules/regulations the way I understand it were suddenly implemented mid-stream - you cant do that. What if in after some time they apply same regulations to say people on EAD and using AC21 (i am still not clear whether it already applies to EAD we will have to wait for legal experts to comment) ? Or worse yet they come up with new regulations for people who already have their GC's approved ?

The current memo is almost like a notice to gradually shut shop for them, it impacts not only the company but the employee and his / her family. If somebody has to return because of a re-definition of "Employer/Employee" then it�s a really bad thing to happen, in this case the ship will sink with all on board.

I think more enforcement would follow, I think it started with issuing RFE's for end client letters(This is a mandatory requirement now for consulting companies). You are correct in saying that the target audience might be the next level!

I am an Indian Tamil and firmly believe that both LTTE and Lankan Army are at fault here. LTTE's tactics have always been to use human cover and the Lankans are guilty of using heavy artillery on civilians. In fact not all the civilians are innocent, some of them are LTTE proponents who prefer to stick with them till their last breath to further promote what is called as Lankan atrocities to the world.
I totally support the Tamil Ealam cause, but the method LTTE has taken would have never gotten them there at the first place. As a country, India should have been a bit more proactive and involved than just supplying arms to the Lankans (which was anyways done to prevent the Lankans from going to the Pakistan or China). So the Indians are just watching the tamasha -- and it is really unfortunate.
How does it bother the Tamilians of India? They are crossed between supporting for Tamil Ealam, death of innocent Tamilians and assassination of Rajiv Gandhi and this leads to mixed feelings. Ideally I would want to see Prabhakaran hanged and Srilankan Tamilians meeting their 3 decade old goals.

I just read through this thread and made some interesting observations.
We all have our own opinions and I am bringing all this into context by considering the fact that most people on this thread are people of Indian origin.
So here is my opinion too.
Looks like there is a process followed by the security officials that flags people based on certain factors.
Now, we can talk for hours and discuss and debate - but we really don't know how such a system is working. It might be working great in the POV of some people who claim that it helps with filtering out the terrorists.
If it is a frequest occurance and is affecting everyone - then there is definitely issues with such a system - but do we hear such stories regularly? We don't. We hear stories of Abdul Kalam or Shilpa Shetty or Sharukh Khan because they are celebrities.
It might be happening quite often and we never know.
It looks like a lot of "discretionary" power lies in the hands of these officers and at times they may just not listen or heed to anyone.
In my opinion a "discretionary" power is something that needs to be associated with good judgement. Rules and systems are in place to "help with things in a good way" and need not be the other way.
If someone feels bad about something - it is not their fault as one cannot control one's feelings. This is exactly what President Obama explained at the "beer summit"
In the modern world the definition of racism has changed. There is nothing called racism or discrimination which relate to their original meanings. For eg.. Indian students in Australia not necessarily be attacked by a particulal race - most time they are attacked by a mob of different kinds of people.
In reality "all of us are living in today's world where there are issues - some are vocal about it, some deny it, some supportit and some oppose it.

It looks like a lot of "discretionary" power lies in the hands of these officers and at times they may just not listen or heed to anyone.
In my opinion a "discretionary" power is something that needs to be associated with good judgement. Rules and systems are in place to "help with things in a good way" and need not be the other way.
If someone feels bad about something - it is not their fault as one cannot control one's feelings. This is exactly what President Obama explained at the "beer summit"
In the modern world the definition of racism has changed. There is nothing called racism or discrimination which relate to their original meanings. For eg.. Indian students in Australia not necessarily be attacked by a particulal race - most time they are attacked by a mob of different kinds of people.
In reality "all of us are living in today's world where there are issues - some are vocal about it, some deny it, some supportit and some oppose it.
Lets think like a cynic - cynical people are good thinkers because all those cynics out there have become so due to series of different experiences the eventually changes the way they think.

I can tell you how corrupt indian govts are from my personal experience.
If someone dies at ur home, to get the govt doctor come and give you clearance to take the body to burial it takes thousands of rupees. Police need no less either. Else your loved one will be waiting for those ***. If you have to claim ur loved ones insurance to take care of expenses during his death, offices play u around... They just want more money!!
I see people changing faith to get free money... its not abt faith but division in our own people. We like foreign cars, foreign made netas, foreign faiths... foreign jobs... oh #!?***
With this happening to you if you are worried abt ur countries outside image... I have nothing to say...
